EMERGENCIES

An emergency is a situation that poses an immediate risk to health, life or property and ultimately requires urgent intervention so as to prevent a worsening of the situation and so if the matter doesn’t fall within this description then we’d be really grateful if you could use the online form.
As a McLean Forth tenant, you are also responsible for keeping the property in a tenant-like manner* which means you are expected to look after and carry out small jobs around the property. Some of these repairs are detailed below, but please note this is not a full list – if you are not sure about a particular repair then please contact the Repairs Team during office hours.
You are responsible for:
- Pest and vermin control
- Damage caused through neglect or misuse of the property by you, your family or visitors
- Cleaning common areas, like closes and staircases.
- Replacing the smoke alarm battery (We can help if the alarm is inaccessible)
- Replacing light bulbs
- Replacing lost keys and meeting the cost of re-entry if you are locked out
*The phrase tenant-like manner relates to the court case Warren v Keen in 1953, and it is still applicable. In his summing up of the case, Lord Denning stated that
The tenant must take proper care of the premises. he must, if he is going away for the winter, turn off the water and empty the boiler, he must clean the chimneys when necessary and also the windows, he must mend the electric light when it fuses, he must unstop the sink when it is blocked by his waste. In short, he must do the little jobs around the place which a reasonable tenant would do. In addition, he must not, of course, damage the house wilfully or negligently but, apart from such things, if the house falls into disrepair through fair wear and tear or lapse of time or for any reason not caused by him, the tenant is not liable to repair it.

You are expected to pay for repairs in your home caused by damage, misuse or neglect – some examples are listed below. If you ask us to fix these repairs – we will let you know the cost and will ask if you want us to carry out the repair or if you would like to organise your own contractor to do the work.
